1. Provider

2. Subject Matter of the Contract and Conclusion of the Contract

The subject matter of the contract is participation in a workshop offered on this website or the purchase of a voucher.

The presentation of workshops and vouchers on the website does not constitute a legally binding offer, but an invitation to make a booking. By submitting the booking and completing the payment process, you make a binding offer. The contract is concluded upon receipt of the booking confirmation by email.

3. Prices and Payment

All prices stated are total prices in euros and include statutory VAT.

Unless otherwise stated, the materials used during the workshop are included in the price. Additional services selected separately will be charged separately.

Payment is processed through the payment service provider Stripe using the payment methods available there. The price is due at the time of booking. A workshop place is only considered securely booked once payment has been received in full.

4. Participation

Participation is generally permitted from the age of 18. Minors may only participate with the prior consent of a parent or legal guardian. Different age restrictions may apply to individual workshops and will be stated in the respective workshop description.

Please arrive on time before the workshop begins. In the event of late arrival, there is no entitlement to an extension, repetition of content already covered, or a refund.

A workshop place may be transferred to another person free of charge after prior notification by email.

5. Cancellation by Participants

A booking may be cancelled up to 14 calendar days before the workshop begins. In this case, you may choose between a one-time transfer to another available workshop and a voucher equal to the amount of the workshop price paid. A cash refund is not available.

For cancellations made at a later date or in the event of non-attendance, no refund will generally be issued. However, the workshop place may be transferred to another person free of charge.

In the event of short-term illness or another comparable important reason, Sunday Studios may voluntarily offer a goodwill solution. There is no entitlement to such a solution.

Cancellations and changes must be submitted by email to hi@sundaystudios.space. The time at which the email is received is decisive.

6. Cancellation or Rescheduling by Sunday Studios

Sunday Studios may cancel or reschedule a workshop, in particular if the required minimum number of participants is not reached, the workshop instructor is ill, the premises are unavailable, or an event of force majeure occurs.

If a workshop is cancelled, you may choose between an alternative date, a voucher, and a full refund of the workshop price paid.

If a workshop is rescheduled, you may attend the alternative date or withdraw from the contract and receive a full refund of the workshop price paid.

Further claims, in particular claims for reimbursement of travel or accommodation costs, only exist where Sunday Studios has caused the damage intentionally or through gross negligence. Claims arising from injury to life, body, or health remain unaffected.

7. Vouchers

Vouchers are sent by email once payment has been received and may be redeemed for the workshops offered on the website, unless otherwise stated for the respective voucher.

Vouchers are transferable and cannot be redeemed for cash. Any remaining credit will remain available on the voucher. The statutory limitation periods apply.

8. Right of Withdrawal

For the booking of a workshop that takes place on a specific date, there is no statutory right of withdrawal pursuant to Section 312g(2)(9) of the German Civil Code. The voluntary cancellation terms under Section 5 apply.

When purchasing a voucher online without a fixed workshop date, there is generally a statutory right of withdrawal of 14 days. Further details are set out in the separate withdrawal policy.

9. Personal Responsibility, Safety, and Liability

Participation in the workshop takes place under the participant’s own responsibility. Participants are required to assess their own abilities and health conditions and to follow the safety, usage, and conduct instructions provided by the workshop instructor.

Please inform us before the workshop begins of any allergies, health limitations, or other circumstances that may be relevant to safe participation. Participants may be excluded from further participation if they disregard safety instructions or endanger other persons.

Sunday Studios is liable without limitation in cases of intent and gross negligence as well as for damage resulting from injury to life, body, or health.

In the event of a slightly negligent breach of material contractual obligations, liability is limited to the foreseeable damage typical for this type of contract. Liability for other damage caused by slight negligence is excluded.

For damage caused exclusively by the disregard of safety instructions, improper use of materials or tools, or pre-existing health limitations that were not disclosed, Sunday Studios is liable only in accordance with the applicable statutory provisions.

Sunday Studios does not assume custody of personal belongings brought to the workshop. The liability provisions set out above remain unaffected.

10. Photo, Image, and Copyright Rights

Photographs and video recordings may be taken during the workshops. Recordings in which participants are identifiable will only be published with their prior consent.

Participation in the workshop is not conditional upon providing such consent. Consent that has been given may be withdrawn with effect for the future.

Templates, documents, and workshop content provided by Sunday Studios or the workshop instructor may be protected by copyright. Commercial reproduction, distribution, or use is not permitted without prior consent.

11. Data Protection

Information about the processing of personal data can be found in our Privacy Policy.

12. Final Provisions

The laws of the Federal Republic of Germany apply. Mandatory consumer protection provisions of the country in which the booking person has their habitual residence remain unaffected.

If individual provisions of these Terms and Conditions are or become invalid, the validity of the remaining provisions remains unaffected.

Sunday Studios is neither willing nor required to participate in dispute resolution proceedings before a consumer arbitration board.
